第四條 本規定所稱外國作品,包括:
(一)作者(zhe)(zhe)或者(zhe)(zhe)作者(zhe)(zhe)之(zhi)一,其他著作權(quan)(quan)人(ren)(ren)或者(zhe)(zhe)著作權(quan)(quan)人(ren)(ren)之(zhi)一是國(guo)際著作權(quan)(quan)條約(yue)(yue)(yue)成員(yuan)(yuan)國(guo)的(de)國(guo)民(min)或者(zhe)(zhe)在(zai)該(gai)條約(yue)(yue)(yue)的(de)成員(yuan)(yuan)國(guo)有(you)經(jing)常(chang)(chang)居(ju)所的(de)居(ju)民(min)的(de)作品(pin)(pin);(二(er))作者(zhe)(zhe)不是國(guo)際著作權(quan)(quan)條約(yue)(yue)(yue)成員(yuan)(yuan)國(guo)的(de)國(guo)民(min)或者(zhe)(zhe)在(zai)該(gai)條約(yue)(yue)(yue)的(de)成員(yuan)(yuan)國(guo)有(you)經(jing)常(chang)(chang)居(ju)所的(de)居(ju)民(min),但是在(zai)該(gai)條約(yue)(yue)(yue)的(de)成員(yuan)(yuan)國(guo)首次或者(zhe)(zhe)同時(shi)發表(biao)的(de)作品(pin)(pin);(三(san))中外(wai)合資經(jing)營(ying)企業、中外(wai)合作經(jing)營(ying)企業和外(wai)資企業按照合同約(yue)(yue)(yue)定(ding)是著作權(quan)(quan)人(ren)(ren)或者(zhe)(zhe)著作權(quan)(quan)人(ren)(ren)之(zhi)一的(de),其委托他人(ren)(ren)創(chuang)作的(de)作品(pin)(pin)。
第十五條 外國作品的著作權人有權禁止進口其作品的下列復制品:
(一)侵權復制品;
(二)來(lai)自對其作(zuo)品(pin)不予(yu)保護的國家的復(fu)制品(pin)。
第十七條 國際著作權條約在中國生效之日尚未在起源國進入公有領域的外國作品,按照著作權法和本規定規定的保護期受保護,到期滿為止。
前款規定不適用于國際著作權條約在中國生效之日前發生的對外國作品的使用。
中國公民或者法人在國際著作權條約在中國生效之日前為特定目的而擁有和使用外國作品的特定復制本的,可以繼續使用該作品的復制本而不承擔責任;但是,該復制本不得以任何不合理地損害該作品著作權人合法權益的方式復制和使用。
前三款規(gui)定依照中國同(tong)有(you)關(guan)國家簽訂的(de)有(you)關(guan)著作權的(de)雙邊協定的(de)規(gui)定實(shi)施。
根據《中華人民共和國商標法》第九條和《保護工業產權巴黎公約》第四條的規定,對巴黎公約成員國國民在中國申請商標注冊要求優先權問題,作如下規定。
一、自一九八五年三月十九日起,中華人民共和國國家工商行政管理局商標局受理巴黎公約成員國國民在中國申請商標注冊要求優先權的事宜。
二、巴黎公約成員國國民,自一九八五年三月十九日起,向巴黎公約任何一個成員國提出了商標注冊申請,其后又在中國就同一商標在相同商品上提出商標注冊申請的,可依巴黎公約規定,在第一次申請后六個月內要求優先權。
三、依前項規定要求優先權的,應當在申請商標注冊的同時提交書面聲明,并且提交在巴黎公約其他成員國第一次提出商標注冊申請的副本,副本應經該國商標主管機關證明,并應注明申請日期和申請號。副本不需認證。但商標局要求提交的其他書件,應當經過認證。
提出要求優先權聲明時,如上述副本和有關證明書件尚未完備,可在提出商標注冊申請三個月內提交。未提交書面聲明或者逾期未提交上述副本和有關書件,視為未要求優先權。
四、要求優先權的(de)(de)聲(sheng)明,經認可(ke)后(hou),在(zai)巴黎公約(yue)其(qi)他(ta)成(cheng)員國第一(yi)次申請商(shang)標(biao)注冊的(de)(de)日期(qi),即視(shi)為在(zai)中(zhong)國的(de)(de)申請日期(qi)。(附英文)

INTERIM PROVISIONS ON CLAIMS FOR PRIORITY IN APPLYING FOR REGI-STRATION OF TRADEMARKS
(Approved by the State Council on March 15, 1985, promulgated by the State Administration for Industry and Commerce on March 15, 1985)
In accordance with Article 9 of the Trademark Law of the People's Republic of China and Article 4 of the Paris Convention for the Protection of Industrial Property, the Provisions on claims for priority in applying for registration of trademarks in China by nationals of the States Parties to the Paris Convention are formulated as follows:
1. From March 19, 1985, the Trademark Office of the State Administration for Industry and Commerce of the People's Republic of China shall entertain claims for priority made by nationals of the States Parties to the Paris Convention in their application for registration of trademarks in China.
2. From March 19, 1985, nationals of the States Parties to the Paris Convention, who after filing an application for registration of a trademark in any other State Party, file another application for registration of the same trademark for the same product in China, may claim priority within six months after the first filing, in accordance with the Paris Convention.
3. An applicant who claims priority according to the provisions of the preceding paragraph shall, at the time of filing the application, submit a written declaration, together with a duplicate of the first application for registration of the Trademark filed in another State Party to the Paris Convention. The duplicate shall be certified by the department in charge of trademarks of that State, and the application date and the application number shall be clearly stated. The duplicate does not need to be authenticated, but the other papers required to be submitted to the Trademark Office shall be authenticated.
When declaring claim for priority, the applicant may, in case the above-mentioned duplicate and the related papers are not available, submit them within three months following the date of second filing. If no written declaration is submitted or the duplicate and the related papers are not submitted at the expiry of three months, the applicant shall not be regarded as having claimed priority.
4. When the written declaration is approved, the date of the first application for registration of the trademark filed in another State Party to the Paris Convention shall be regarded as the application date in China.
